Kingfisher Caravan Park is located in the popular holiday resort of Ingoldmells on the Lincolnshire coast, not far from Skegness. The caravan park is owned by East Lindsey District Council and for years the Council and caravan owners lived harmoniously together. People brought their caravans on this site because it was owned by the Council and the Council were committed to delivering an excellent, friendly and efficient service. They even told people that they would never remove their caravans off the site as long as they were fit for purpose.
Several times the council has flexed it muscles and proposed to change the rules on the age of the caravans, but every time they have realised that they either cannot or should not be progressing change that would be contrary to their relationship with the owners on the site.
In 2017 the Council tried to introduce an age limit on caravans, along with other changes. At this time the Owners on the site decided to stand-up and say no! We protested, presented challenge in Council meetings, raised complaints, petitioned the Council and the Government and then in August 2017 the Chief Executive Office and the Senior Councillor sent a letter stating "all proposed changes have been consigned to history".
In 2019 a new Manager was brought in with a history of trying to introduce change on caravan parks against the wishes of the owners. Behind close doors the Council schemed about what to do and then at the very end of the 2019 season issued a notice that they were scrapping the current arrangements and introducing stringent new contracts with a loads of significant changes.....
Did this get discussed with the owners? --- NO
Were the owners given sufficient time to review and share with legal representatives before signing or removing their caravans? -- NO
Did it feel like 'bully boy' tactics? -- YES
Enough was enough we all joined together. Submitted funds into a pot to support our campaign (initially £20,000 significant amount added since). Appointed solicitors. Signed the new agreements 'Under Duress' informing the Council this was the case and then proceed to challenge what they were doing. Our legal submissions were formulated, supported by precedence, connected back to legislation and focused to support further progression to court.
How did the Council react? They ignored us all the way through 2020 until October (1 year later), then had the audacity to say "We disagree with your challenge" - no reasoning, no supporting legislation, no precedence just "We are the Council and we disagree".
